Under the District of Columbia's rental housing disclosure requirements, a housing provider (property owner or landlord) must provide prospective tenants with a completed Housing Provider's Disclosures to Applicant or Tenant form at the time of rental application or, if no application is required, when entering into a lease or rental agreement.
The disclosure includes ownership and management information, rent stabilization or exemption status, condominium or cooperative status, housing code violations issued within the previous 12 months, unresolved violations, known unremediated mold conditions within the previous 3 years, monthly rent, additional charges, security deposit terms, and applicable rent increase restrictions. The housing provider must also provide required supporting documents, including RAD Form 4 (Rent History Disclosure), RAD Form 5 (Notice of Access to Records), and the Tenant Bill of Rights.
Existing tenants may request updated disclosures once per calendar year, and the housing provider must respond within 10 business days. The form also specifies a 45-day deadline after termination of tenancy to return the security deposit or provide notice of intended deductions, followed by an additional 30 days to provide any remaining balance and itemized deductions. Failure to comply with applicable rental housing disclosure requirements may result in administrative enforcement or other legal consequences.
