In Washington, D.C., a seller of a cooperative unit must disclose information regarding cooperative fees, special assessments, underlying mortgages, and other relevant financial obligations. The seller is required to obtain a resale disclosure package at the seller's expense, including the cooperative's governing documents, financial statements, operating budget, pending litigation, and membership application requirements.
The package must be delivered directly to the buyer within 10 business days after contract ratification. Delivery to the buyer's agent alone does not satisfy this requirement. The buyer has 3 business days after receiving the package to cancel the contract without penalty. If the package is provided on or before ratification, the cancellation period runs for 3 business days after ratification. If the seller fails to deliver the package within 10 business days, the buyer may cancel the contract at any time before receiving it. Cancellation rights expire at settlement.
