In Washington, D.C. a seller of a property subject to a homeowners association (HOA), must disclose information regarding HOA fees, special assessments, outstanding balances, approved fee increases, and other relevant association obligations. The seller is required to obtain a resale disclosure package at the seller's expense, including the HOA's governing documents, financial statements, operating budget, reserves, insurance coverage, pending litigation, and applicable restrictions.
The package must be delivered directly to the buyer within 10 business days after contract ratification. Delivery to the buyer's agent alone does not satisfy this requirement. The buyer has 3 business days after receiving the package to cancel the contract. If the package is provided on or before ratification, the cancellation period runs for 3 business days after ratification. If the seller fails to deliver the package within 10 business days, the buyer may cancel the contract at any time before receiving it. Cancellation rights expire at settlement. The seller must also pay any delinquent HOA fees and special assessments and resolve outstanding HOA violations before settlement.
