Under the District of Columbia Lead-Hazard Prevention and Elimination Act of 2008 (D.C. Code § 8-231.01 et seq.), property owners of rental properties built before 1986 are required to provide tenants with a completed D.C. Lead Disclosure Form before the tenant signs a lease. Property owners must provide available supporting documentation upon the tenant's request and retain the signed disclosure for at least 6 years from the most recent signature.
For properties built before 1978, the separate federal lead-based paint disclosure and EPA-approved informational pamphlet are also required under 24 CFR Part 35 and 40 CFR Part 745. Failure to comply with D.C. disclosure requirements may result in civil fines, administrative enforcement, and other legal consequences.
