Under the District of Columbia Lead-Hazard Prevention and Elimination Act of 2008 (D.C. Code § 8-231.01 et seq.), a seller of residential property built before 1978 is required to provide the buyer with a completed D.C. Lead-Based Paint Disclosure Form before the buyer signs a purchase agreement. This disclosure is required in addition to the federal lead-based paint disclosure under 24 CFR Part 35 and 40 CFR Part 745.
The seller must disclose known lead-based paint, deteriorating paint, contaminated dust or soil, and any pending government notices, violations, or orders related to lead hazards. The seller must also provide the EPA's Protect Your Family from Lead in Your Home pamphlet and make available any existing lead inspection reports or related documentation upon the buyer's request. The seller must retain the signed D.C. disclosure form for at least 6 years from the date of the most recent signature. Failure to comply may result in civil penalties, administrative enforcement, or other legal consequences.
