Under the District of Columbia Condominium Act (D.C. Code § 42-1904.11), a seller of a condominium unit is required to provide the buyer with a resale disclosure package containing the condominium's governing documents, financial information, fees and assessments, insurance coverage, pending litigation, and other relevant association information.
A seller must obtain the resale package at the seller's expense and deliver it directly to the buyer within 10 business days after contract ratification. Delivery to the buyer's agent alone does not satisfy this requirement. The buyer has 3 business days after receiving the package to cancel the contract without penalty.
If the package is provided on or before ratification, the cancellation period runs for 3 business days after ratification. If the seller fails to deliver the package within 10 business days, the buyer may cancel the contract at any time before receiving it. The buyer's cancellation rights expire at settlement.
