Maryland Residential Property Disclosure and Disclaimer Statement

Maryland law requires sellers of certain residential properties to provide buyers with either a Residential Property Disclosure Statement, identifying known defects and property conditions, or a Residential Property Disclaimer Statement, stating that the property is being sold “as is” without representations or warranties. Even when using the disclaimer, sellers must disclose any known latent defects that pose a direct threat to health or safety and would not reasonably be discovered through a careful visual inspection. Certain transfers, including some new construction, foreclosures, estate or fiduciary transfers, and unimproved land, are exempt.
