Maryland Code requires that a seller of property located in a development subject to the Maryland Homeowners Association Act provide certain documents and disclosures to the buyer.
The Maryland Association of Realtors ("MAR") has created forms to aid the seller completing their disclosure obligations. Included in the MAR forms are documents for:
- Initial sale of a lot in a development that has more than 12 lots to a buyer who will occupy/rent the lot for residential purposes. Maryland Code Section 11B-105
- Initial sale of a lot in a development to a person who will NOT occupy or rent the lot for residential purposes. Maryland Code Section 11B-107
- Resale of a lot in a development of ANY size OR initial sale of a lot in a development that has 12 or fewer lots to a buyer who will occupy/rent the lot for residential purposes. Maryland Code Section 11B-106
- Notifying a buyer of changes to a previously provided document.
Where Can I Get a Copy of These Disclosures?
