Per NMSA 1978, § 47-13-4, an Estimated Property Tax Levy disclosure is required to be provided to prospective buyers before an offer to purchase is accepted. Prior to accepting an offer, a seller must request the estimate from the county assessor and provide the written estimate to the buyer or the buyer’s broker. The county assessor is required to supply this estimate by the end of the next business day after the request is received.
This disclosure is intended to help buyers understand potential future property taxes, which may differ from current taxes. A buyer may waive the right to receive this disclosure in writing before submitting an offer. However, if not waived in writing failure to follow the disclosure requirements could expose sellers to potential legal claims or disputes, particularly if a buyer later argues they were not properly informed.
