California Health & Safety Code §§ 19211, 18031.7, and California Code Of Regulations Title 25 §4102 require that a home's water heater is properly secured in accordance with applicable law. In addition, a property seller must certify that the water heater is in compliance with applicable law. Exceptions apply.
The California Association of Realtors (CAR) has the following forms which provide the required certification statement:
- California Transfer Disclosure Statement (TDS)
- Water Heater and Smoke Detector Compliance (WHSD), if TDS is not used
For used mobile homes, used manufactured homes, and used multi-unit manufactured housing there is an HCD form to be used and provided to the buyer within 45 days before the transfer of title.
