California Health & Safety Code §§ 13113.7, 13113.8, 18029.6 requires that properly functioning smoke alarms are installed and in the correct locations on the date of transfer of title.
NOTE: Local laws may be more restrictive than state requirements. Check with your local city and/or county building and safety departments.
Sellers are also required to provide a written statement that the property is in compliance with state law. The California Association of Realtors (CAR) version of the California Transfer Disclosure Statement contains a statement of compliance. CAR form "Water Heater and Smoke Detector Compliance" (WHSD) may also be used.
How Do I Get the Correct Disclosure Form?
