Under Iowa Code Chapter 558A, most sellers of residential property with one to four dwelling units are required to provide buyers with a written Sellers Disclosure of Property Condition. This disclosure explains the known condition of the property to ensure buyers receive key information about the property before they are legally committed to the purchase.
The disclosure must be delivered to the buyer before offer acceptance. If it is delivered late, the buyer may cancel the contract without penalty within three days of personal delivery or five days of delivery by mail.
Sellers must also provide the “Iowa Radon Home-Buyers and Seller Fact Sheet” prepared by the Iowa Department of Public Health. Failure to comply may allow the buyer to cancel the contract and may be addressed through the courts.
How Can I Get a Copy of the "Iowa Sellers Disclosure of Property Condition" form?

- Bare ground
- Property containing 5 or more dwellings units
- Court ordered transfers
- Transfers by a power of attorney
- Foreclosures; lenders selling foreclosed properties
- Transfers by a fiduciary in the course of the administration of a decedent's estate, guardianship, conservatorship, or trust. This exemption shall not apply to a transfer of real estate in which the fiduciary is a living natural person and was an occupant in possession of the real estate at any time within the twelve consecutive months immediately preceding the date of transfer
- Transfer between joint tenants, or tenants in common
- Transfers to or from any governmental division
- Quit claim deeds
- Transfers between family members or between divorcing spouses; Commercial or agricultural property which has no dwellings.
