Montana Water Rights Acknowledgement

The purpose of Water Rights Acknowledgment is to clarify that, in Montana, water rights are the right to use water and do not necessarily transfer with the land. It explains that water rights are subject to a statewide adjudication process and that ownership, quantity, and legal status may be uncertain. The addendum further states the importance of independent review when water rights are a factor in a transaction.

This document is an addendum to a contract and not a disclosure. It can be included in a response to a buyer when an offer is accepted. It does not need to be attached to your listing as a disclosure.
