In Montana, sellers and landlords are required to provide a written notice to a potential buyer or tenant only if they know mold is present on the property or if the property has been tested for mold. This requirement, found in MCA § 70-16-703, applies before a purchase contract or lease is signed. If applicable, the disclosure must include any available mold test results and information about prior remediation or cleanup.
