When selling a condominium in Montana, the law requires a specific Condominium Disclosure/Addendum to ensure the buyer understands how the building is managed. Under MCA § 70-23-613, the seller must provide the buyer with a copy of the Montana Unit Ownership Act, the association's bylaws, and any other rules or regulations that govern the property.
If the seller owns a majority of the units in the building, they must specifically disclose this, as it gives them significant control over any future rule changes. Most importantly, a buy-sell agreement is not legally effective until 72 hours after the buyer receives these documents. During this three-day window, the buyer has the right to cancel their offer without any penalty.
