Under Kentucky law, KRS 324.360, sellers of residential property are required to give buyers a written disclosure statement describing the condition of the home. This form asks sellers to provide information about important parts of the property, including the roof, foundation, plumbing, electrical system, heating and cooling systems, water and sewer services, and other structural components.
Sellers must report any known material defects or issues that could impact the property's value or influence a buyer's decision to purchase. The law only applies to problems the seller is aware of and does not require them to perform inspections or uncover hidden defects. However, sellers cannot ignore obvious issues or claim they did not know about conditions that a reasonable property owner would recognize. A seller who intentionally hides a defect, provides false information, or fails to deliver the required disclosure form may be held legally responsible for fraud, misrepresentation, or violations of Kentucky’s disclosure laws.
