New Hampshire law requires sellers of residential property to provide buyers with a written Property Disclosure Form before the buyer makes a written offer. This requirement is established under RSA 477:4-c. The disclosure informs buyers about the seller’s actual knowledge of material defects affecting the property, such as structural issues, mechanical systems, water supply, sewage systems, environmental hazards, and other significant conditions that could affect the property’s value or safety.
The disclosure must be completed honestly and in good faith, based on the seller’s knowledge at the time it is filled out. If a disclosure is not provided before an offer is made, the buyer has the right to rescind the purchase contract after receiving the disclosure.
