The Cesspool Replacement Disclosure informs sellers that under the Rhode Island Cesspool Act, R.I. Gen. Laws § 23-19.15, most properties served by a cesspool must have that cesspool abandoned and replaced with an approved septic system, other onsite wastewater treatment system, or connected to public sewer (if available) within 12 months after a sale or transfer of the property.
The requirement is triggered by the closing or transfer date, not the contract date, and has applied to sales since January 1, 2016, with limited exemptions for certain family transfers. Buyers and sellers may negotiate who will pay the replacement costs, and financing options may be available through municipalities or lenders. If the seller is unsure whether a cesspool exists, the law requires an inspection by a DEM-registered system inspector before closing. This disclosure is provided by the seller to ensure buyers are informed of the legal obligation created by the transfer of the property.
