The Connecticut Residential Foundation Condition Report is a required disclosure for certain residential property sales in towns identified as affected or potentially affected by crumbling concrete foundations, when the property was acquired through foreclosure, a deed in lieu of foreclosure, a court judgment, or by a political subdivision.
The form requires a seller to disclose, based on the seller’s knowledge, whether there is any presence of pyrrhotite in the concrete foundation, any known damage or deterioration, and any repairs or remediation that have been completed. This report must be given to a prospective purchaser before the purchaser signs any binder, purchase contract, option, or lease with a purchase option.
The requirement is governed by Connecticut General Statutes § 20-327c under the Uniform Property Condition Disclosure Act. If a seller does not provide this report when required, the seller must credit the purchaser $500 at closing, and failure to disclose known material information may also result in civil liability.
