Oklahoma statute 41-113a of the Oklahoma Landlord and Tenant Act states that landlords have a legal obligation to inform tenants, in writing, if the rental property is in a flood hazard area or has flooded within the last five years, using the Tenant Flood Notice form. This notice must be provided at lease signing to ensure tenants know their risk and the need for renter's insurance. If a landlord fails to disclose this past flooding, the tenant has a right to sue for any personal property damage that occurs as a result of flooding.
