New Jersey has adopted a new statewide Flood Risk Notification Law that requires both property sellers and landlords to give clear, written information about a property’s flood risk before a buyer or tenant commits. The law was created to improve transparency as flooding becomes more common throughout the state.
Who must disclose?
- Sellers: Any person or entity selling residential or commercial property in New Jersey must now disclose the property’s flood risk as part of the standard Seller’s Property Condition Disclosure Statement.
- Landlords: Landlords leasing residential or commercial property for one month or longer must provide a written Flood Risk Notice to new and renewing tenants.
Where can I get a copy of the required disclosure forms?
We will provide you a copy of the current disclosure form published by the New Jersey Realtors for free upon submitting a flat fee MLS listing through our website.
The seller flood risk disclosure form is built into the Seller’s Property Condition Disclosure Statement form and the landlord Flood Risk Notice form is provided as a separate disclosure document, both of which we provide to you.
