Residential new construction is exempt from the same property condition disclosure required for existing homes under Idaho Code § 55-2501. However, sellers must disclose information about the property’s annexation and city services. Under Idaho Code § 55-2503, “residential real property” generally includes properties with one to four dwelling units, individually owned units, and properties with both residential and commercial uses.
Sellers must provide the buyer or buyer’s agent with a signed and dated disclosure within 10 calendar days after accepting the buyer’s offer. The buyer then has 3 business days after receiving the disclosure, or an amended disclosure, to cancel the agreement in writing based on a specific issue with the information disclosed. If the buyer does not provide written notice within that time, the statutory right to cancel is waived.
