West Virginia is considered a "caveat emptor" (buyer beware) state, which means sellers are not required to complete a state-mandated property disclosure form like those used in many other states. However, that does not mean sellers have no disclosure obligations.

Under West Virginia law, sellers of residential properties containing one to four dwelling units must disclose known material defects and cannot intentionally conceal defects or misrepresent the condition of the property.
