This Delaware form explains when a seller is exempt from providing the standard property condition disclosure and radon disclosure under Title 6, Chapter 25, §2577 of the Delaware Code. In general, while most residential sales require sellers to disclose known material defects and radon information, certain types of transactions may qualify for an exemption. When an exemption applies, the seller does not have to complete the usual disclosure forms.
By signing this form, the seller confirms that the transaction qualifies for an exemption, and the buyer acknowledges that they will not receive the standard disclosures. The form also includes general notices encouraging buyers to do their own research on the property, including zoning, environmental risks, taxes, and future development. Even when exempt, buyers are still responsible for their own due diligence since they may not receive detailed information from the seller.
