Utah Seller's Property Condition Disclosure (Land)

Under Title 57, Utah land sellers are required to disclose any known material defects that could negatively impact a property's value and would not be readily apparent to a reasonable buyer. For vacant land transactions, sellers typically complete the Seller's Property Condition Disclosure (Land) form, which addresses matters such as soil conditions, water rights or availability, boundary issues, and zoning restrictions.

Although Utah generally follows the doctrine of "caveat emptor" (buyer beware), sellers remain legally obligated to disclose known latent defects—issues that are not easily discoverable through ordinary inspection. Failure to disclose such defects may expose a seller to claims of fraud, misrepresentation, or other legal liability.
