Nevada Revised Statutes 320.130 governs the sale of property that lies within a road maintenance district. A road maintenance district is a special district created to fund the upkeep of private or county roads. These districts assess property owners within the district to pay for road maintenance services such as grading, resurfacing, snow removal, or other necessary work.
What Is Required Of Sellers?
Sellers must provide written notice to a buyer if the property is located within a road maintenance district.
The notice must state the existence of the district and disclose the amount of assessments that have been charged against the property for the preceding two years.
If the road maintenance district has been in existence for less than two years, the seller must disclose assessments for the period since the district was created.
Is There a Specific Form That I Need to Supply To a Potential Buyer?
No. Nevada does not require this disclosure to be made on a state-issued form. However, it is strongly recommended that you provide any disclosures in writing or by email so you have a clear record that the disclosure was made.
What If This Disclosure Isn't Provided?
Failure to provide this notice prohibits the seller from completing the sale of the property.
