Tennessee Code (2019 version linked) requires that the owner of the residential property shall, prior to entering a contract with a buyer, disclose in the contract itself or in writing, including acknowledgement, if the property is located in a Planned Unit Development (PUD), and make available to the buyer a copy of the development's restrictive covenants, homeowner bylaws and master deed upon request.
The Tennessee Realtors versions of the Tennessee Residential Property Condition Disclosure includes a question to assist sellers in satisfying this requirement. Sellers may still need to provide the development's documents noted above, upon request by the buyer.
