The Notification to Buyer of Potential Short Sale (Form NSS) is to be used as a notification to the Buyer that a particular transaction may result in a short sale.
In a short sale, lenders may take an extended period of time to respond—or may not respond at all—making it difficult to establish a definite closing date. Even when approval is granted, lenders often impose conditions, such as refusing to pay closing costs or disallowing seller-paid repairs. While neither the buyer nor the seller is obligated to accept these conditions, declining them may cause the agreement to be terminated. For these reasons, disclosure to a buyer is required if a seller believes their property may be involved in a short sale.
